Criminal law is one of the main branches of law, through which social relations are defended and the system of combating crime is founded.

In a criminal case, a person may have the capacity of:

  • suspect: person against whom there is (over whom there is) a reasonable suspicion that they have committed an act provided for by criminal law);
  • defendant: person against whom criminal proceedings have been initiated on the basis of the evidence in the case file;
  • injured party: person who has suffered harm as a result of the commission of the offense;
  • civil party: person who brings a civil action in criminal proceedings with a view to obtaining compensation for the damage caused by the offense;
  • civilly liable person person who, according to the law, has a legal or contractual obligation to repair the damage caused by the crime that is the subject of the case;
  • witness: person suspected of being able to provide information about the commission of an act provided for by the criminal law;

THE CRIMINAL TRIAL HAS 4 STAGES:

  1. Criminal prosecution
  2. Preliminary Chamber
  3.   Judgment
  4. Enforcement

Regardless of the capacity you have in a criminal case, it is particularly important to know that you have the right to be assisted by a lawyer throughout the proceedings. One of the biggest mistakes a person can make, part of a criminal case, is to postpone the employment of a lawyer. Legal services do not become cheaper, faster, or easier if time passes, the evidence is consolidated, the prosecution ends, and the lawyer is hired directly at the first hearing on the merits or directly on appeal.

Our area of practice in criminal law includes:

  • Law 286/2009 – Criminal Code;
  • Law no. 143/2000 on preventing and combating illicit drug trafficking and use;
  • Law no. 241/2005 on the prevention and combating of tax evasion;
  • Law 86/2006 – Customs Code;
