Medical Law
With the advent of medical reform, by means of Law 95/2006, the responsibility of medical professionals received its own regulation. Based on the Medical Reform and related legislation, medical professionals can be held liable for civil, criminal or disciplinary reasons, with penalties ranging from a simple warning to a ban on practicing the profession or, as the case may be, their conviction.
Liability may be committed to the extent that the medical act is not performed in compliance with professional standards, ethical and deontological norms specific to the field or in the situation where the medical staff has committed an act provided by the criminal law.
However, a careful and objective analysis of the existence of a direct causal link between the damage claimed by the injured person and the medical act or treatment, as well as the determination of their classification within the scope of foreseeable adverse effects or symptomatic manifestations inherent in medical procedures or treatments, is necessary, to avoid the risk of significant unsubstantiated consequences on the image and reputation of health professionals.
